LGBTQ+ Custody Cases in Texas

Custody cases are more complex for a same-sex couple then they are for legally married, opposite-sex couples in terms of seeking custody or support for children. Determining custody and the parentage of a married heterosexual couple is generally more cut and dry when each spouse is the biological parent.

For an LGBTQ+ couple, a Texas marriage license doesn’t mean that each spouse is the presumptive parent of a child born during the course of the marriage. Instead, the non-biological parent must legally adopt the child or children to be considered their parent in the eyes of the law. Adoption, therefore, is a necessary step that not only allows a parent to seek custody in the case of a divorce, but also benefits the child in that they will then be legally entitled to all the financial and social privileges that biological parents and children share.
